What Type Of Power Of Attorney Do I Need, And Why?
In Queensland, there are different types of Power of Attorney.
- A general power of attorney is the best choice when you are mentally sound, and need someone who can take care of legal or financial details while you are away, or need some assistance managing things. If you become mentally unsound, or unable to make decisions, a general power of attorney is revoked, immediately.
- An enduring power of attorney is the best option if you need someone to take care of legal and financial matters on your behalf, that extends beyond your mental capacity. They must be nominated when you are mentally sound and able to make decisions though. They will be able to act on your behalf if your mental capacity diminishes.
- An advance care directive relates only to healthcare matters, and the nominated person will have no power to act on your behalf for financial and legal matters.
An enduring power of attorney provides lasting peace of mind and ensures that you have directions in place if you can no longer manage your legal and financial affairs.
You can have multiple EPOAs appointed too, drafted in a number of ways, including:
- Appointing two children who need to agree on all decisions jointly, or
- Appointing your partner for legal EPOA and a sibling for financial EPOA
